Die Kanzlei klagt. Das Bundesberufungsgericht des fünften US-Bezirks erörtert in leicht verständlicher Weise und lesenswert die Wirksamkeit eines EMail-Vertrags:
Under Louisiana law, a "contract is formed by the consent of the parties established through offer and acceptance. Unless the law prescribes a certain formality for the intended contract, offer and acceptance may be made orally, in writing, or by action or inaction that under the circumstances is clearly indicative of consent." La. Civ. Code Ann. art. 1927 (2008). Where a writing and/or a signature is required to form a contract, an email will satisfy such requirement. See La. Rev. Stat. Ann. §9:2607; Klebanoff v. Haberle, 43–102 (La. App. 2 Cir. 3/19/08); 978 So. 2d 598, 600–04; Dozier v. Rhodus, 08–1813 (La.
