Im Fall Kingsmill v. Roundo AB hatte der Hersteller aus Schweden eben diesen Erfolg: Keine hinreichenden Beziehungen zu den USA, obwohl er seine Maschinen dorthin vertrieb. Dabei ging er vorsichtig vor, wie das Bundesgericht im Forumstaat Pennsylvania bei der Abwägung der Merkmale des Long Arm Statute und der bundesverfassungsrechtlichen Minimum Contacts am 18. Juli 2013 feststellte:
Roundo's principal place of business is in Hässleholm, Sweden; it maintains neither offices nor personnel in Pennsylvania, and it has no affiliates, agents, or property of any kind in the state. Neither has Roundo ever been licensed to do business in Pennsylvania, nor does Roundo directly market or advertise in the state. Roundo has never sent a representative into Pennsylvania. The machine in question reached Pennsylvania in August of 2003, when Plaintiff's employer purchased it from Roundo's former exclusive distributor for the United States, Comeq, which is located in Maryland. … Comeq initially purchased the machine from Roundo, which Roundo delivered to Comeq in Maryland.
Notably, Roundo has never made a direct sale or delivery to anyone in the United States. Instead, Comeq purchases the machines from Roundo, which Roundo delivers to Comeq. AaO 2.
